Giftaweb Terms of Service
This English version is provided for the convenience of international customers. In case of any discrepancy between the Estonian and English versions, the Estonian version prevails.
1. General
1.1. These terms govern the provision of services through the website giftaweb.com (hereinafter Giftaweb).
1.2. The service provider is Navik OÜ (hereinafter Service Provider):

- Giftaweb is a trade name and trademark of Navik OÜ.
1.3. Customer means a natural person or legal entity who enters into a contract with the Service Provider through Giftaweb (hereinafter Customer).
1.4. By ordering the service through Giftaweb, the Customer confirms that they have reviewed and agreed to these terms.
2. Service description
2.1. Giftaweb provides a website design service as a gift. The service includes:
- One (1) custom OnePage-style website built from the Customer's brief (form data)
- Registration of one (1) domain in the Customer's name for one (1) year from the date of registration
- Website hosting for one (1) year from the date of handover
2.2. The base price of the service is 99 euros. Pricing may differ based on the Customer's selected country or currency, and will be clearly displayed to the Customer before order submission. The price is fixed and does not include VAT (Navik OÜ is not VAT-liable as it is below the turnover threshold).
2.3. Service delivery times:
- First draft sent to the Customer: 5 business days from the time the Customer has submitted the form and all required information has been received (including logo, business description, list of services, contact details).
- Website publication: 7–10 business days depending on the speed of the Customer's feedback and the time spent in the approval round.
- The Service Provider will inform the Customer if delivery times may be exceeded during high-demand periods (e.g., Mother's Day, Christmas).
- Note: If the Customer submits the form without a logo or with incomplete information, the 5-day deadline only starts once the missing information has been provided to the Service Provider.
2.4. The price does not include:
- Post-order content or design changes (see section 7)
- Website renewal after the first year
- Domain renewal after the first year
- Separate photography services, copywriting, or additional features (e-commerce, booking systems, etc.)
3. Order process
3.1. A Giftaweb gift card can be purchased from the Service Provider's website. After payment is received, the buyer receives a PDF gift card with a unique code and QR code.
3.2. The recipient of the gift card redeems the gift by entering the code on the Giftaweb page and filling out the brief form (company details, style, images, etc.).
3.3. After the form is submitted, the Service Provider:
- Reviews the brief
- Prepares the first draft (with AI assistance, under the Service Provider's quality control)
- Sends the draft to the Customer for review
- Makes adjustments based on the Customer's feedback
- Publishes the finished website on the Customer's domain
3.4. The Service Provider reserves the right to contact the Customer first if the brief is incomplete or unclear, before preparing the draft.
4. Gift card validity
4.1. The gift card is valid for at least one (1) year from the date of purchase. In some countries, the validity period may be longer under local law; in such cases, the minimum required by the law of the relevant country applies.
4.2. If the gift card has not been redeemed within six (6) months, the Service Provider sends an automatic reminder to the recipient's email address.
4.3. After the validity period ends, the gift card is cancelled and is not subject to refund.
5. Payment terms
5.1. Payment is made in advance, the full price (99 euros) in a single payment.
5.2. Accepted payment methods:
- Bank link — funds received instantly
- Bank card (Visa, Mastercard) — funds received instantly
- Bank transfer (against an invoice from Navik OÜ) — order starts within 1 business day after receipt
- Other payment methods displayed on the Service Provider's website at the time of purchase
5.3. After payment is received, the Buyer is sent an electronic invoice by email along with a link to the gift management page, where both the gift card and invoice can be downloaded and forwarded to the recipient.
6. Content responsibility
6.1. The Customer is responsible for the legality of the content (texts, images, logos, references, data) submitted in their brief. By submitting the form, the Customer confirms that:
- they have the right to use the submitted images (their own images or under a licence agreement)
- the submitted texts do not infringe third-party copyrights
- the submitted information is accurate and not misleading
6.2. The Service Provider is not obliged to verify the legality of the Customer's submitted content. The Service Provider reserves the right to refuse to provide the service if the Customer submits content that:
- infringes third-party copyrights or other rights
- contains illegal material (hate speech, pornography, violence, discrimination)
- is clearly misleading or fraudulent
- violates good faith
6.3. If the Service Provider identifies content that cannot be published under section 6.2, they will notify the Customer. If the Customer does not provide replacement suitable content, 79 euros will be refunded; 20 euros remain with the Service Provider as a service fee compensating the costs of starting the service.
6.4. The Customer is obligated to compensate the Service Provider for any damages arising from the Customer's unlawful content (e.g., third-party claims, fines).
7. Modifications
7.1. The initial order includes up to two (2) revision rounds on the first draft (e.g., "change the font", "rearrange sections", "swap colour palette"). Larger changes (new sections, added features) are not part of the initial order.
7.2. After the website is published, the price includes 0 (zero) free changes. All subsequent changes and additions are chargeable.
7.3. The price for subsequent changes is 40 euros per hour (minimum 30 minutes = 20 euros). Changes are ordered by email (veeb@navik.ee).
7.4. Add-on price list (orderable via giftaweb.com/en/enhancements):
- Additional page (e.g., portfolio, gallery, additional services page): 99 euros fixed price
- Additional language (translation of an existing site into a new language): 70 euros fixed price
- Booking system (e.g., appointment or schedule calendar): from 200 euros, final price by agreement depending on complexity
- E-commerce (simple cart with up to 10 products, payment module integration): from 400 euros, final price by agreement depending on the number of products and delivery terms
- Other integrations (CRM connector, newsletter, user accounts, etc.): price by agreement
An exact-price quote is sent within 2 business days after the request is received.
8. Intellectual property and copyright
8.1. All proprietary copyright in the specific design, code, and structure of the website created by the Service Provider under this agreement transfers to the Customer (the gift card recipient who redeemed the gift card, filled out the brief form, and approved the finished website) at the moment of final publication of the website.
8.2. The buyer of the gift card (the orderer who purchased the gift card for another person) does not acquire copyright in the website, except where the buyer and the redeemer are the same person.
8.3. The Customer has full right to subsequently modify, extend, or migrate the finished website to another hosting provider.
8.4. The Service Provider reserves the right to use the finished website's design and screenshots (anonymised if requested) in their portfolio and marketing materials.
8.5. The Customer understands and agrees that AI-assisted generated elements may be used in creating the website, which may not be subject to exclusive copyright protection.
9. Right of withdrawal
9.1. In accordance with section 53⁸ paragraph 2 point 3 of the Estonian Law of Obligations Act, a consumer has the right to waive the 14-day right of withdrawal if the provision of the service has begun, with the consumer's consent, before the withdrawal period has expired.
9.2. By ordering a Giftaweb gift card or by filling out the redemption brief form, the Customer gives explicit consent for the service to start immediately and thereby waives the 14-day right of withdrawal.
9.3. The consent is documented in the Service Provider's database with a timestamp.
10. Quality and complaints
10.1. The Service Provider warrants that the service provided meets the requirements ordinarily expected of such a service.
10.2. The Customer is obliged to notify the Service Provider of any defect in the service immediately after detection, but no later than two (2) months from the date of website publication.
10.3. If the defect is caused by the Service Provider, the Service Provider will fix the defect free of charge.
10.4. The Service Provider is not liable for:
- Errors arising from incorrect data submitted by the Customer
- Outages of third-party services (e.g., Cloudflare, domain registrar)
- The Customer's own subsequent changes to the website
- The availability of the desired domain at the moment of actual registration (if the Customer's desired domain is registered by a third party before the Service Provider can register it — the Customer will be asked to choose an alternative domain)
10.5. Limitation of Liability. The Service Provider's total liability arising out of or in connection with this agreement is limited to the amount actually paid by the Customer for the Service.
The Service Provider shall under no circumstances be liable for:
- indirect damages
- lost revenue or profits
- damages from business interruption
- reputational damage
- damages arising from data loss
This limitation does not affect a consumer's statutory rights arising from imperative consumer protection norms in the consumer's country of residence.
11. Personal data protection
11.1. The Service Provider processes personal data in accordance with the Privacy Policy published at giftaweb.com/en/privacy.
12. Dispute resolution
12.1. These terms are governed by the law of the Republic of Estonia, without prejudice to the application of mandatory consumer protection norms arising from the law of the consumer's country of residence.
12.2. A consumer may turn to the Consumer Disputes Committee (komisjon.ee) or via the European online dispute resolution platform (ec.europa.eu/consumers/odr).
12.3. Court disputes are resolved in Harju County Court.
13. Force Majeure
13.1. The Service Provider shall not be liable for the failure or delay in performance of its obligations to the extent that such failure or delay is caused by circumstances beyond the Service Provider's reasonable control (force majeure), including, but not limited to:
- natural disasters (earthquake, flood, storm)
- war, terrorism, riots
- pandemics and epidemics
- government decisions and sanctions
- nationwide or regional internet outages
- prolonged outages of third-party services (including Cloudflare, domain registrars, payment services)
- general labour strikes
13.2. In a force majeure event, the Service Provider will inform the Customer without delay and either agree on a new schedule or refund the amount paid.
13.3. During force majeure, all deadlines are extended by the duration of the obstruction.
13.4. This clause does not affect a consumer's statutory rights arising from imperative consumer protection norms in the consumer's country of residence.
14. Modification of terms
14.1. The Service Provider reserves the right to modify the terms. Changes are notified to the Customer by email or on the website. Changes take effect 14 days after publication.
14.2. Contracts already concluded are governed by the terms in force at the time of contract conclusion.
